Kausik (Rejected) CRM (M) 469 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Tamluk Police Station Case No. 825 of 2025 dated 16.10.2025 under Sections 64(2)(m)/294/351(3) of the Bharatiya Nyaya Sanhita, 2023. Report submitted by the State be kept with the record. Learned advocate appearing for the petitioner submits that petitioner is in custody since 16th October, 2025 and although charges have been framed in the instant case, but till date witness action has not commenced. Learned advocate for the State opposes the prayer for bail, drawn the attention of the Court to the statement of the victim under Section 183 of the BNSS. The recovery which was made in course of investigation has been also reflected in the case diary and the mobile phone has been sent to the Cyber Forensics and Digital Evidence Examiners Laboratory, the same is awaiting for the report. 2 In view of the nature of accusations in the present case, I am of the opinion that, at this stage, the petitioner’s prayer for bail cannot be acceded to. However, petitioner would be at liberty to approach this Court after the evidence of the victim is over. Accordingly, CRM (M) 469 of 2026 is dismissed at this stage. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
