Learned advocate appearing for the petitioners submits that in spite of directions of this Court, prosecution has been slow in recording evidence. It has been contended that petitioners are in custody from first week of January, 2025 and there is no scope of the trial concluding in near future. As such, petitioners may be released on bail Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that pursuant to the earlier directions passed by this Court on 13.11.2025 in CRM (M) 1757 of 2025, the Trial Court has examined four witnesses. It has also been pointed out that charges were framed on 14.05.2025 and prosecution intends to examine 24 witnesses in support of its case. Till date, 14 witnesses have already been examined. Having considered that ten more witnesses are left to be 2 examined, I direct the learned Trial Court that in spite of cooperation of the present accused persons, within a period of six months, if the learned Trial Court is unable to conclude the trial, learned Trial Court would be at liberty to grant bail to the present petitioners on such terms and conditions as it deems fit and proper for ensuring further appearance of the petitioners before the Trial Court. At this stage, the prayer for bail of the petitioners is rejected. With the aforesaid directions, the application for bail, being CRM (M) 482 of 2026, is disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
