02/29.04.2026 Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Itkhori P.S. Case No. 9 of 2026, registered for the offence under Sections 317(5), 274, 275, 292 and 3(5) of Bhartiya Nyaya Sanhita, 2023, Section 47(a) of the Excise Act pending in the court of learned Additional Chief Judicial Magistrate, Chatra.

Learned counsel appearing for the petitioner submits that the petitioner happens to be the owner of Fronx car from which 144 bottles of foreign liquor were recovered. He next submits that the petitioner was not present in the vehicle, the vehicle was being driven by the brother of this petitioner and four persons were sitting in the vehicle and his brother has already been apprehended.

Learned counsel appearing for the State has opposed the prayer and submits that the petitioner happens to be owner of the said Fronx car.
5. Considering that the petitioner is owner of the said car and the car was being driven by his brother, who has already been apprehended and in that view of the matter, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned Court within two weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Chatra, in connection with Itkhori P.S. Case No. 9 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
