ORDER Date : 18.03.2026 This is a common order for both the Bail Applications.
1. Heard Mr. B. J. Mukherjee, learned Counsel for the petitioners. Also heard Mr. Bhaskar Sharma, learned Additional Public Prosecutor for the State of Assam.
2. Both these application are filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, whereby the petitioners Bulbul Hussain and Shyam Kamti @ Shatyam Kamti have prayed for releasing them on bail after they were arrested in connection with Manikpur P.S. Case No.12/2016.
3. Police got an information that one tanker would be transporting stolen petroleum products and will be sold at a particular petrol pump at Patiladaha. Accordingly, both the petitioners, while they were transporting the petroleum products were arrested.
4. The petitioners are the driver and handyman of the said tanker.
5. Today, the petitioners have submitted a tax invoice showing that they were carrying the goods after somebody purchased the same.
6. The petitioners have submitted that they are only the driver and the handyman of the tanker.

7. I have considered the submissions made by learned counsel for the both sides.
8. Both the petitioners have already completed 40 days in judicial custody.
9. This Court under the given circumstances is of the opinion that the petitioners no longer deserve to be detained in custody.
10. Therefore, the bail applications of the petitioners are allowed.
11. The petitioners Bulbul Hussain and Shyam Kamti @ Shatyam Kamti shall be released on bail of Rs.25,000/- each with a surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Bongaigaon.
12. With the aforesaid direction, both the bail applications stands closed and
