OMP (M) No. 29/2026 The present application has been filed for condonation of delay in filing the main appeal. It has been averred in the application that though the certified copy of the impugned order, dated 1.8.2024 was prepared and delivered to the applicant on 29.8.2024, however due to inadvertence and oversight, the same was misplaced and could not be traced despite best efforts. Upon retrieval of the certified copy, after due diligence, prompt action was taken for preparation of the appeal. Thus, the aforesaid delay is neither intentional nor deliberate, but has occurred due to unavoidable circumstances, which were beyond the control of the applicant. The learned counsel for the respondents has no objection for the instant application being allowed. Consequently, in view of the reasons stated in the application, which is duly supported by an affidavit, coupled with submissions made by the learned counsel for the parties, delay in filing the main appeal is condoned.
