NIRMALA RAO 2 Hon'ble Shri Justice Rakesh Mohan Pandey Order on Board 24.04.2026 1. The petitioner has filed this petition seeking the following reliefs:- “10.1. That, it may be declared that Petitioner is employed under State Panchayat & Rural Welfare department and is entitled for all the benefits arising out of the employment under said department. 10.2. That, the Hon'ble Court may kindly direct the respondents to consider the services of petitioner in the Panchayat and Rural Development Department to the post of Assistant Grade III, with monetary, emoluments and other benefits from his date of appointment. 10.3. Any other relief, which this Hon'ble Court may deemed just and fit in facts and circumstances of the case.” 2. Learned counsel for the petitioner would submit that the father of the petitioner was Assistant Development Extension Officer under respondent No.6, who died in harness on 11.12.2003. He would submit that the petitioner applied for compassionate appointment and he was offered appointment against post of Peon in District Rural Development Agency (DRDA). He would submit that DRDA is an agency under the Panchayat Department whereas, the petitioner should have been granted appointment within the Panchayat Department itself. Furthermore, the affidavit filed by State categorically states that the petitioner has since been promoted to the post of Assistant Grade-III, Zilla Panchayat, District Rural Authority, Baikunthpur. The documents annexed alongwith the affidavit would 3 show that the petitioner is currently an employee of the District Rural Development Agency, Baikunthpur, District Korea. As the father of the petitioner was an employee of Panchayat and Rural Development Department, the petitioner ought to have been offered an appointment within that specific department. 3. Heard. 4. Taking into consideration the above-stated facts, the respondent authorities particularly respondent No.6 is directed to consider the claim of the petitioner for appointment in the Panchayat Department against sanctioned and vacant posts. The services already rendered by the petitioner with the agency shall be counted as service rendered in the Panchayat Department. 5. With the aforesaid observation(s), this petition is disposed of.
