[2026:RJ-JP:19982] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 6956/2026 Rajeev Kumar Meena S/o Rameshwar Prasad, Aged About 39 Years, R/o Village Paparda, Police Station Paparda, District Dausa. (At Present In Central Jail, Ajmer). ----Petitioner Versus The State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Mr. Kamal Kumar Gupta For Respondent(s) : Mr. Jaiprakash Tiwari, PP Mr. Asgar Khan HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 12/05/2026 1. The petitioner has preferred this bail application under Sec- tion 483 of BNSS in FIR No. 131/2025 registered at Police Station Arain, District Ajmer for offences under Sections 318(4), 316(2) and 61(2) of B.N.S., 2023. 2. Heard learned counsel for the petitioner as well as learned Public Prosecutor and counsel for the complainant and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He again submitted that the petitioner along with other co-accused have executed an agreement to sale the agriculture land to complainant and there- after due to non-compliance of above agreement, Petitioner has sold the above land to another person and for that a civil suit for [2026:RJ-JP:19982] (2 of 3) [CRLMB-6956/2026] specific performance of contract is also pending between the par- ties in which the temporary injunction has been granted by the competent Civil Court in favour of the complainant. Learned coun- sel contended that the matter is purely civil in nature which has been given the criminal colour with connivance of concerning po- lice authorities. The petitioner is behind the bars since 16.04.2026 without any criminal past. The trial of the case will take consider- able time, therefore, no fruitful purpose would be served by keep- ing the petitioner in further custody, consequently the bail applica- tion deserves to be allowed. 4. In support of his contention, he has relied on the judgment of the Hon'ble Supreme Court delivered in the case of Mala Choudhary & Anr. V/s In state of Telangana & Anr., 2025 INSC 870. 5. The learned counsel for the complainant as well as Public Prosecutor vehemently opposed the bail application and submitted that the petitioner has duped the complainant by selling the agri- culture land to another person despite earlier agreement. Hence, looking to the gravity of the offence, the petitioner is not entitled for any relief. 6. On consideration of the rival submissions and material available on record and in light of submissions made by learned counsel for the petitioner but without expressing any opinion on merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner. 7. Consequently, the bail application under Section 483 B.N.S.S. is allowed and it is directed that the petitioner Rajeev Kumar Meena S/o Rameshwar Prasad, be released on bail [2026:RJ-JP:19982] (3 of 3) [CRLMB-6956/2026] provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court on all subsequent dates of hearing till conclusion of the trial.
