… … Petitioner Versus The State of Jharkhand
… … Opposite Party
CORAM: HON'BLE MR. JUSTICE RAJESH SHANKAR -----
For the Petitioner
: Mr. Binod Kumar Dubey, Advocate
For the State
: Mr. P.D. Agarwal, Spl.P.P. -----
Order No.02
Date: 30.04.2026
1.
Heard learned counsel for the parties.
2.
The petitioner is an accused for the offences punishable under Sections 47(a), (b), (c), (d) of Jharkhand Excise Act.
3.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the offence report. It is further submitted that on perusal of the offence report, it would be evident that the alleged recovery of illicit liquor was made from the house of the co-accused Anil Yadav. The petitioner has been roped in the present case mainly due to the reason that he was present at the place of occurrence and was allegedly capping the liquor bottles. It is, however, wrong to allege that the petitioner was involved in the alleged offence. Though the petitioner has one more criminal case pending against him, however, the same does not relate to the offence under the Excise Act. The petitioner is in judicial custody in connection with the present case since 17.03.2026. Hence, the petitioner may be given the privilege of regular bail.
4.
Learned Spl. P.P. opposes the petitioner’s prayer for bail.
5.
Having heard learned counsel for the parties, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner
