NARENDRA PRASAD ORAL ORDER This writ petition is filed under Article 227 of the Constitution of India, challenging the order dated 20.11.2024 passed on I.A.No.2, filed by the plaintiff under Section 151 of the CPC in O.S.No.2447/2023, directing the petitioner/defendant to pay arrears of rent amounting to Rs.1,50,000/- to the plaintiff. 2. This Court, by order dated 19.12.2024, directed the petitioner to deposit a sum of Rs.1,50,000/- before the trial court, and further directed that the said amount shall not be released by the trial court until an appropriate order is passed by this Court. 3. Since the suit for ejectment is pending consideration, the amount deposited by the petitioner/defendant is directed to be released in favour of the plaintiff, subject to the condition that the plaintiff shall execute a bond for a sum of Rs.1,50,000/- before the trial - 3 - HC-KAR NC: 2026:KHC:12809 WP No. 34758 of 2024 court. Further, the release of the amount shall also be subject to the result of the suit. The trial court is directed to dispose of the suit as expeditiously as possible, and in any event, not later than one year from the date of receipt of a certified copy of this order.
