The present writ petition has been filed by petitioner challenging the judgment and decree dated 14.06.2023 passed by learned Civil Judge (Senior Division), Pauri Garhwal, in Civil Suit No.46 of 2022 The Nainital Bank Ltd. Vs. Vinod Singh & Ors., whereby, the Suit filed by respondent No.1-Bank was decreed; as well as the judgment and order dated 27.09.2025 passed by learned District Judge, Pauri Garhwal, in Civil Revision No.15 of 2023 Vinod Singh Vs. The Nainital Bank Ltd., whereby, the revision petition filed by petitioner has been rejected. 4. Since, the decree has been passed against the petitioner, he has a right to challenge the same in First Appeal under Section 96 of the CPC. But, instead of filing the First Appeal, Civil Revision No.15 of 2023 was filed by the petitioner, therefore, there is no infirmity found in the judgment and order passed by learned District Judge, Pauri Garhwal, while rejecting the Civil Revision only on the ground that the decree should have been challenged in the First Appeal. 2026:UHC:256 5. At this stage, learned counsel for petitioner made a prayer to permit him to withdraw the present writ petition enabling him to avail the remedy available under the law. 6. The prayer, so made, is granted. 7. Accordingly, the present writ petition is dismissed as withdrawn with the aforesaid liberty. (Pankaj Purohit, J.) 07.01.2026 PN
