1. Apprehending his arrest in connection with FIR No.372/2025, registered at Police Station Khairthal, Distt. Khairthal-Tijara, for the offence(s) punishable under Section(s) 115(2), 126(2) & 189(2) BNS, the petitioner has preferred this anticipatory bail application under Section 482 of BNSS.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case and he has nothing to do with the alleged offences. Learned counsel further submits that the other co- accused persons, namely Wasim and Sakrulla, have already been granted anticipatory bail by a Co-ordinate Bench of this Court. Learned counsel also submits that main allegation has been levelled against the co-accused person, namely Anees.
Learned counsel further contends that it is a case of version and cross-version as well as there is no criminal antecedent against the petitioner. He also contends that custodial interrogation of the petitioner is not required in this case, hence, the petitioner may be given the benefit of anticipatory bail under Section 482 of BNSS.

3. Per contra, learned Public Prosecutor as well as learned counsel for the complainant oppose the submissions made by learned counsel for the petitioner.

Considering the contentions put-forth by learned counsel for the petitioner and taking into account the totality of facts & circumstances of the case; the fact that there is no criminal antecedent against the petitioner; other co-accused persons have already been granted anticipatory bail and main allegation is levelled against the co-accused, namely Anees, but without commenting anything upon the merits / demerits of the case, this Court deems it just and proper to grant the benefit of anticipatory bail to the petitioner.

Accordingly, the anticipatory bail application under Section 482 BNSS is allowed and it is ordered that in the event of arrest of petitioner namely, Muin S/o Nawab Khan, in connection with FIR No.372/2025, registered at Police Station Khairthal, Distt. Khairthal- Tijara, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the SHO / IO / Arresting Officer of the concerned Police Station on the following conditions:- (i) The petitioner shall make himself available for interrogation by a police officer as and when required. (ii) The petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or any police officer, and (iii) The petitioner shall not leave India without previous permission of the Court.
