1. This MCC has been filed for correction/modification of the order dated 19.11.2025 passed in WPS No.4247/2023.
2. Learned counsel for the Applicant submits that there was some confusion regarding the date of filing of the charge sheet, therefore, the application for modification in the order dated 19.11.2025 passed in WPS No.4247/2023 has been preferred to ensure proper compliance therewith.
3. Evidently, in the order dated 19.11.2025 itself, this Court has clarified that on the date of the DPC meeting, no charge sheet/charge memo had been filed. Therefore, there is no requirement under the law to keep the recommendation for promotion in respect of Respondent No.1 pending in a sealed cover. Consequently, no modification is warranted in the order dated 19.11.2025.
4. It is made clear that since no charge sheet had been filed as on the date the DPC meeting was convened, any charge sheet filed subsequently cannot be considered as a ground to withhold the promotion of Respondent No.1.
