This is an application directed against the order passed by the Learned Additional Sessions Judge, 2nd Court, Coochbehar dated 09.04.2025 in Criminal Appeal No. 15 of 2024. 2. The husband filed an application under Section 29 of Protection of Woman from Domestic Violence Act, 2005. The Trial Court being the Learned Judicial Magistrate, 3rd Court, Sadar Coochbehar directed that the husband being the petitioner herein shall pay monetary relief of Rs.5,000/- per month to the wife being the respondent herein with further directions. 3. Being aggrieved and dissatisfied, an appeal was preferred being Criminal Appeal No. 15 of 2024. The Learned Appellate Court directed that the 2 petitioner-husband shall pay a sum of Rs.7,000/-; the arrear shall be paid in 20 equal installments along with current amount and an alternative accommodation shall be secured by the husband. 4. Heard the Learned Counsel for the parties. 5. As agreed, the husband-petitioner shall pay monetary relief of Rs.7,000/- per month to the wife which will include Rs.5,000/- per month as monetary relief and Rs.2,000/- towards rent of separate accommodation. The husband need not secure an alternative accommodation for the petitioner. The arrear amount shall be paid in 12 equal installments as directed with the current amount. In case of default of payment the respondent-wife shall be at liberty to draw up execution proceeding. 6. The order passed by the Learned Additional Sessions Judge, 2nd Court, Coochbehar stands partly modified accordingly. 7. The instant application stands disposed of. (Sugato Majumdar, J.)
