Azad & Anr. … Petitioner(s) Mr. Asit Nayek … for the Petitioner(s) Mr. Madhusudan Sur, ld. APP Mr. Nirupam Dhali … for the State-respondent(s) Learned advocate for the petitioners submits that from the joint possession of the petitioners, allegedly 433 kg of poppy straw were recovered. The petitioners are in custody for more than one year twenty five days, charge- sheet has been submitted, as such, he prays that the petitioners may be enlarged on bail. Learned advocate for the State opposes the prayer for bail. Having regard to the rigors of Section 37 of the NDPS Act being attracted, I am not inclined to enlarge the petitioners on bail at this stage. Hence, the prayer for bail of the petitioners is Rejected. 2 However, the petitioners would be at liberty to approach this court after the evidence of the seizure list witnesses are over. Accordingly, CRM (NDPS) 563 of 2026 is dismissed. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.)
