IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.466 of 2026 P. Kishan@Puli Kishan …. Petitioner Mr. B. Mohanty, Advocate -Versus- State of Odisha …. Opposite Party Ms. B.K. Sahoo, AGA CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 27.01.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioner seeking pre-arrest bail in connection with P.R. No.10 of 2025-26 corresponding to 2(a) C.C. Case No.128 of 2025 pending in the court of learned J.M.F.C., Khallikote on the grounds stated. 3. Perused the P.R. as at Annexure-1. 4. In the meantime, the final PR is submitted. A copy of the said PR is at Annexure-2. The submission is that the petitioner apprehends arrest on account of the confessional statement of the co-accused persons and the final P.R. i.e. Annexure-2. Recorded the objection of the State. Upon reading of the final P.R. at Annexure-2, the Court finds that the petitioner and two other accused persons are responsible for possession and transportation of I.D. liquor. In fact, 550 liters of I.D. liquor along with a four-wheeler have been seized in connection with the case. Considering the above facts and submissions of learned counsel for the respective parties and release of the co-accused, namely, Purusottam Sahu, this Court is not inclined to grant pre-arrest bail to him, however, is of the view that the petitioner should be directed to surrender before the J.M.F.C., Khallikote seeking regular bail in connection with 2(a) C.C. Case No.128 of 2025 during the first hour for the day and in case of rejection, to approach the learned Sessions court for consideration of his release during the second hour for orders without any adjournment followed by a decision considering the plea of parity and accordingly, it is ordered. 5. Consequently, the ABLAPL is disposed. 6. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik) Judge Balaram Designation: PERSONAL ASSISTANT
