By virtue of the present application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the applicant seeks grant of interim bail for a period of three months in FIR No.137/2017 dated 31.03.2017 registered at PS.: Timarpur, under Sections 302/201 of the Indian Penal Code, 1860 (IPC). 2. At the outset, Mr. Surya Pratap Singh has entered appearance on behalf of the applicant. In view of the same, Ms. A. Sahitya Veena, Advocate seeks discharge of the erstwhile counsel for the applicant, Mr. Faraz Maqbool, Advocate (DHCLSC). As such, Mr. Faraz Maqbool is discharged from the present matter. The applicant has moved the present interim bail application on medical ground of his minor son, aged about 3 years, who is stated to be suffering from autism spectrum disorder and requires specialised therapy and medical treatment. During the pendency, learned counsel for the applicant also submits that the medical condition of his father has also been deteriorated substantially and has been advised to undergo surgical procedure. 4. Learned counsel for the applicant submits that the applicant herein is the sole bread earner of his family, and in his absence his family is facing extreme hardship both mentally and physically. 5. Learned APP has handed over a copy of the latest Status Report, which is taken on record. He opposes the present interim bail application and submits that the offence committed by the applicant is heinous in nature. Moreover, she submits that the applicant is also habitual in jumping bail and has not surrendered on the stipulated dates on various occasions. 6. In reply to the same, learned counsel for the applicant assures this Court and undertakes that the applicant will surrender on the stipulated date and will also abide by the terms and conditions as imposed by this Court. 7. This Court has heard learned counsel for the parties and have gone through the documents on record as also the Status Report. 8. Considering the peculiar facts of the present application inasmuch as the applicant is the sole earner of his family as also is required to take care of both his ailing father and son, this Court deems it appropriate to release the applicant on interim bail purely on humanitarian grounds. Accordingly, the applicant is directed to be released on interim bail in FIR No.137/2017 dated 31.03.2017 registered at PS.: Timarpur, under Sections 302/201, for a period of three weeks from the date of his release, subject to him furnishing a personal bond in the sum of Rs.25,000/- [Rupees Twenty Five Thousand] along with one surety of the like amount by family member/ friend having no criminal case pending against them and further subject to the satisfaction of the concerned Jail Superintendent and also subject to the following conditions:- (i) The applicant shall not leave Delhi/ NCR without prior permission of this Court and shall ordinarily reside at the address as per prison records. (ii) The applicant shall present himself before the Investigating Officer/ S.H.O. Timarpur, once a week between 11:00 A.M. and 11:30 A.M. to mark his presence. However, he will not be kept waiting longer than an hour for this purpose. (iii) The applicant shall furnish to the Investigating Officer/ S.H.O. PS.: Timarpur a cell-phone number of one family member on which the applicant may be contacted at any time and shall ensure that the number is kept active and switched-on at all times. (iv) In addition to the above, the applicant shall share his real- time/ live location on Google Maps with the Investigating Officer and shall keep that setting ‘on’ at all times during the period of interim bail, so that the concerned Investigating Officer may be able to verify the applicant’s location, at any time. (v) If the applicant has a passport, he shall surrender the same to the concerned Jail Superintendent and shall in no case travel out of This is a digitally signed order. (vi) The applicant shall not contact, nor visit, nor offer any inducement, threat or promise to any of the prosecution witnesses or other persons acquainted with the facts of case. The applicant shall not tamper with evidence nor otherwise indulge in any act that is unlawful or that would prejudice the proceedings in the pending trial. (vii) Upon expiry of the three weeks period of interim bail, the applicant shall surrender before the concerned Jail Superintendent on or before 12:00 P.M. on the date of expiry of three weeks from the date of his release. 10. Accordingly, the present application is allowed and disposed of in the aforesaid terms. 11. A copy of the order be sent to the concerned Jail Superintendent for information and compliance forthwith.
