According to petitioner, he was engaged as Seasonal Collection Amin in 1991 in Tehsil Haldwani of District Nainital and his service was subsequently regularised on 04.12.2012. 4. Petitioner contends that other Seasonal Collection Amins, who were also regularised in 2012 were given certain benefits, by taking their services rendered after 09.11.2000 to be regular, however, similar benefit is not extended to the petitioner. 5. By means of this writ petition, petitioner has sought a direction to the competent authority to grant benefit of continuous service to the petitioner on the post of Collection Amin w.e.f. UKHC010110062026 2026:UHC:5179 09.11.2000 and also to grant other consequential benefits. 6. Learned State Counsel, however, submits that petitioner is a fence sitter; he relies upon a judgment rendered by Co-ordinate Bench in 2017, but, he has not explained in the writ petition the reason for delay in approaching this Court. He also submits that there is nothing to indicate that petitioner made a formal demand by making a representation before the competent authority. 7. Learned counsel for the petitioner submits that petitioner may be permitted to make representation. 8. The writ petition is, accordingly, disposed of by permitting petitioner to make representation to the District Magistrate concerned. If he makes representation within two weeks from today, decision thereupon shall be taken, as per law, within four months thereafter.
