NARASINGH Order No. ORDER 27.04.2026 01. 1. Heard learned counsel for the Petitioner and learned counsel for the State. 2. The Petitioner is an accused in connection with G.R. Case No. 125 of 2026, pending in the Court of learned JMFC, Hinjilicut, arising out of Hinjili P.S. Case No. 108 of 2026, for commission of alleged offences U/s. 303(2) & 3(5) of BNS, 2023. 3. Learned counsel, on instruction, submits that except the present BLAPL, no other bail application of the Petitioner relating to the aforementioned P.S. Case is pending in any other Court. 4. Being aggrieved by the rejection of his application for bail U/s. 483 of the BNSS by the learned Addl. Sessions Judge, Chatrapur, Ganjam by p. 2 order dated 06.03.2026, the present BLAPL has been filed. 5. It is submitted by the learned counsel that the Petitioner is in custody since 17.02.2026 and since investigation has been progressed substantially and the paddy in question is stated to have been recovered, he may be released on bail. 6. Learned counsel for the Petitioner submits that he has criminal antecedents. 7. Learned counsel for the State opposes the prayer for bail inter alia he has criminal antecedent of similar nature. 8. Considering the nature of allegations and the recovery and the punishment prescribed, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned Court in seisin. 9. Additionally, it is directed that Petitioner shall appear before the jurisdictional police station once every month on such date and time to be fixed by the learned Court in seisin till submission of final form.
