order with Signatures COURT’S OR JUDGE’S ORDERS
WPMS No.224 of 2026 Hon’ble Alok Mahra, J.
Mr. Prakash Chandra, Advocate for the petitioner.
Mr. Shashank Upadhyaya, Advocate for respondent nos.1 to 3.
2. The petitioner asserts that he is a bona fide student of Class XI of H.R. Public School, Roorkee Road, Laksar, District Haridwar, an institution duly affiliated with the Central Board of Secondary Education (CBSE). As per the regulations of the Board, students studying in Class XI are mandatorily required to be registered for the Senior Secondary Examination, and the last date prescribed for such registration was
31.10.2025. It is the specific case of the petitioner that he was suffering from jaundice and other related ailments, on account of which he could not attend the school from 02.07.2025 to 03.11.2025. After his recovery, he rejoined the school and submitted the requisite medical certificates duly issued by a registered MBBS medical practitioner. Considering the medical condition of the petitioner, the school forwarded a request to the Board on 14.11.2025 seeking permission to register the petitioner for the Senior Secondary Examination. However, the said request was declined by the Board vide communication dated 09.12.2025 on the ground that the last date for registration had already expired on
31.10.2025.
3. Heard
learned counsel for the
2026:UHC:611 parties and perused the record. The Court finds that the case of the petitioner is a genuine one and involves the academic future and career of a student. Non-registration of the petitioner in Class XI would result in grave and irreparable prejudice, as he would be deprived of appearing in the Senior Secondary Examination and, consequently, two valuable academic years of his life would stand wasted. The absence of the petitioner from the school was not deliberate or intentional, but was on account of illness, which stands duly supported by valid medical certificates issued by a registered medical practitioner.
4. In view of the peculiar facts and circumstances of the case, and keeping in mind the paramount consideration of safeguarding the future of a student, this Court is of the considered opinion that the respondents cannot adopt a rigid and technical approach in the matter.
5. Accordingly, the respondent nos.1 and 2 are directed to register the name of the petitioner in Class XI for the purpose of Senior Secondary Examination, subject to payment of the prescribed fee, including any applicable late fee, in accordance with the Rules.
6. The writ petition stands ordered accordingly.
