1. Heard Learned counsel for the applicant; and Sri Devesh Nath Tiwari, Learned A.G.A. and Sri Shiv Babu, learned Brief Holder, appearing for the State. 2. The present anticipatory bail application has been filed on behalf of the applicant in Case Crime No. 657 of 2025, under Sections 319(2), 318(4), 338, 336(3), 340(2), 316(5), 61(2) and 238 of the B.N.S., 2023, and Section 66D of the Information Technology Act, Police Station – Kotwali Karwi, District Chitrakoot, with a prayer to enlarge him on anticipatory bail, as the applicant apprehends his arrest in the aforesaid case. 3. The Learned counsel for the applicant has submitted that the applicant is an old man. A false allegation of the applicant being involved with treasury officials and misappropriating excess pension amount received in his account has been made. The applicant has been implicated by the actual accused who are the treasury officials and middlemen. The applicant is an old man who is also economically weak. Despite this, he has tried to deposit part of the amount received in his account. The Learned counsel has stated that Rs.2 lakhs has been deposited by the applicant and he would make all efforts to deposit the rest of the amount as per his capability. 4. Sri Shiv Babu, Learned Brief Holder appearing for the State has stated that a cumulative amount of Rs.60,45,480/- has been credited in the account of the applicant and only a meager amount of Rs.2 lakhs has been Versus Counsel for Applicant(s) : Jitendra Prasad Mishra, Prakhar Kumar Kushwaha Counsel for Opposite Party(s) : G.A. refunded. Learned A.G.A. however does not dispute the fact that many other accused have been granted anticipatory bail by this Court
5. I have considered the submissions made by the Learned counsel for the parties. 6. Co-accused Nareshdutt Mishra, Jagannath Prasad and Ritesh Tripathi @ Munnu have been granted anticipatory bail by this Court in NABAIL Nos.10416 of 2025, 7790 of 2026 and 8003 of 2026. The applicant is stated to be a pensioner who has received excess pension amount in his account on account of conspiracy with treasury officials.
The applicant to show his bona fides has also refunded a part of the misappropriated amount. 7. In the prima facie opinion of this Court, taking note of the old age of the applicant and also the fact that the similarly situated co-accused have been granted anticipatory bail by this Court, a case for grant of anticipatory bail is made out. 8. The anticipatory bail application of the applicant is allowed. 9. In the event of the arrest of the applicant- Arvind Kumar Shukla, involved in the aforesaid case crime, he shall be released on anticipatory bail, on his furnishing a personal bond and surety in the like amount to the satisfaction of the Station House Officer of the police station/Court concerned, with the following conditions:- i. The applicant shall make himself available for interrogation by a police officer as and when required; ii. The applicant shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; iii. The applicant shall not leave India without the previous permission of the Court; iv. The applicant shall not pressurize/intimidate the prosecution witness;
10. In case of breach of any of the above conditions, the Court concerned shall be at liberty to cancel the bail. NABAIL No. 9675 of 2026 2
11. It is made clear that observations made hereinabove are exclusively for deciding the instant anticipatory bail application and are not to be considered to be an opinion on the merits of the case.
