JUSTICE S SUNIL DUTT YADAV ORAL ORDER The petitioner has, by memo dated 13.01.2026, restricted the prayer in the present writ petition to prayer at clause (b) and (c) and did not press with respect to the prayer at clause (a). Insofar as the remaining payers at clause (b) and (c) of the prayer column, the petitioner had sought for issuance of writ of mandamus to direct the respondent No.2 to pay the compensation as per the present market value or to grant an alternative land as per Annexure-'C'. 2. It is the case of the petitioner that the petitioner's land had been acquired and that compensation was not - 3 - HC-KAR NC: 2026:KHC:7675 WP No. 28535 of 2025 granted. Aggrieved by the same, the present writ petition has been filed. 3. Insofar as the grant of alternative land is concerned, learned counsel appearing for the respondents submits that, as there is no such Scheme, the question of considering such prayer does not arise. 4. Insofar as the assertion regarding non-payment of compensation, the memo dated 09.02.2026 has been filed. 5. Learned counsel appearing for the respondents would submit that compensation has been paid to the petitioner. He has further submitted that the petitioner has sought for reference to the Civil Court for enhancement of compensation. 6. Various documents have been placed along with the memo and relied upon. 7. Learned counsel for the respondent further submits that what would remain is the right of the - 4 - HC-KAR NC: 2026:KHC:7675 WP No. 28535 of 2025 petitioner to claim enhancement, which is an aspect to be considered only by the Reference Court. 8. In light of the documents produced by the respondent Nos.2 and 3, the petition is disposed of keeping all contentions open to be raised before the appropriate Authority and the matter does not call for adjudication in these proceedings.
