5.
In para 52 of the case diary said Hari Chutiya Purty himself has stated that the vehicle in question has already been taken away by this petitioner in the year, 2022 itself as he has not been able to pay the
consideration amount. It has also come that the vehicle has been taken away by the petitioner by taking signature of Hari Chutiya Purty on non- judicial stamp paper. It has been captured in the mobile by Hari Chutiya Purty. The said photograph was shown to the Investigating Officer by Hari Chutiya Purty wherein non-judicial stamp number was found to be 06AA030063 and date is incorporated in the said paper was 03.11.2021 which was of the petitioner. The document produced by Hari Chutiya Purty the date was said to be 03.11.2025. The document produced by the petitioner noted Eng No. GLBIE45351 wherein the document produced by Hari Chutiya Purty in the paper it was stated as Eng. No. and thereafter it was kept vacant. In the document produced by Hari Chutiya Purty there was no eye witness and in the document produced by this petitioner there were three eye witness. Prima facie it appears that only to escape from liability all these acts have been done by the petitioner.
6. In the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for anticipatory bail is hereby rejected.
