PUBLIC PROSECUTOR The Court made the following: COMMON ORDER: Criminal Petition has been filed under Section 528 Bharatiya Nagarik Suraksha Sanhita Act, 2023 (for brevity the ‘BNSS’) by the Petitioners/Accused Nos.1 and 2, seeking to quash the proceedings against them in C.C.No.2535 of 2025 on the file of the learned II Additional Judicial Magistrate of First Class, Nellore registered for the alleged offences punishable under Sections 498-A and 494 of the Indian Penal Code, 1860 (for brevity ‘the I.P.C’) and Section 3 and 4 of the Dowry Prohibition Act, 1961 (for brevity ‘the D.P. Act’). 2. I.A.No.1 of 2026 is filed by the Petitioner/de-facto complainant/ Respondent No.2 seeking permission to compound the Respondent No.2/de- facto complainant to compromise the proceedings in C.C.No.2535 of 2025 on the file of the learned II Additional Judicial Magistrate of First Class, Nellore against Respondents/Accused Nos.1 and 2. 3. I.A.No.2 of 2026 is filed by the Petitioner/de-facto complainant/ Respondent No.2 seeking to record compromise between the Petitioner/de- facto complainant and the Respondents/Accused Nos.1 and 2 as per the joint 3 Dr.YLR,J Crl.P.No.1957 of 2026 Dated 21.04.2026 memo and quash the proceedings against them in C.C.No.2535 of 2025 on the file of the learned II Additional Judicial Magistrate of First Class, Nellore. 4. The learned Counsel for the Petitioner submits that a case in M.C. No.1161 of 2024 was filed before the Principal Family Judge at Bangalore, wherein a decree of divorce was granted, dissolving the marriage between Petitioner No.1 and Respondent No.1. 5. Today, when the matter was taken up for hearing, the Petitioners/Accused Nos.1 and 2 and Respondent No.2/de-facto complainant were present before this Court. They produced their respective attested copies of Aadhar cards in proof of their identity, and the same were placed on record for proper identification. Both the learned Counsel on record identified both the parties in open Court. 6. Sri A.Sai Rohith, learned Assistant Public Prosecutor for the State, reported no objection to record the compromise. 7. This Court enquired the de-facto complainant about her willingness to enter into a compromise in the matter. She represented before the Court that she had voluntarily come forward for the compromise. The de-facto complainant further represented that the case may be closed against the accused persons, and she does not want to prosecute the matter against the Petitioners/Accused Nos.1 and 2. 4 Dr.YLR,J Crl.P.No.1957 of 2026 Dated 21.04.2026 8. Considering the submissions and in the light of the judgment of the Hon’ble Apex Court in Gian Singh vs. State of Punjab and another1, since there is an amicable settlement between the parties, in the interest of justice, I.A.Nos.1 and 2 of 2026 are allowed. 9. Consequently, Criminal Petition is allowed, and the proceedings against the Petitioners/Accused Nos.1 and 2 in C.C.No.2535 of 2025 on the file of the learned II Additional Judicial Magistrate of First Class, Nellore are hereby quashed.
