ORDER:
The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No.160 of 2025 of Kodavalur Police Station, Sri Potti Sriramulu Nellore District, registered for the alleged offences punishable under Sections 137(2), 70(1) and 115(1) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity ‘the BNS’). 2. Heard the learned counsel for the Petitioner, the learned Assistant Public Prosecutor and the learned legal aid counsel for the Respondent No.2. Perused the record. 3. Mr.Jitendra Kanyalur, the learned counsel for the Petitioner, submits that the Petitioner is innocent of the alleged offence and he has been falsely implicated in the alleged offence. He has not committed any offence. He is law-abiding citizen. He has got fixed abode. The Petitioner undertakes to abide by any conditions that this Court may impose while granting bail to the Petitioner. Hence, it is urged to allow the Criminal Petition. 4. Per contra, Mr.K.Sandeep, the learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the Petitioner and submitted that though the Charge Sheet has already been filed in the case, the accusations

against the Petitioner are well founded. Hence, it is urged to dismiss the Criminal Petition. 5. Mr.M.Ravikanth Reddy, the learned Legal Aid Counsel for Respondent No.2, argued on the same lines as the learned Assistant Public Prosecutor, supporting the allegations against the Petitioner and opposing the enlargement of the Petitioner on bail. 6. As seen from the averments of the complaint lodged by Respondent No.2/victim and on perusal of the entire record, including the charge sheet, it is evident that the Petitioner/Accused No.1 along with another person/juvenile in conflict with law, on 27.11.2025 at about 10.00 AM, forcibly took the victim by gagging her mouth into the van of the Petitioner. He drove the van to some distance, assaulted the victim with their hands, removed her clothes despite her resistance and refusal, and subjected her to sexual intercourse one after another inside the van. It is further alleged that the Petitioner and the other person took photographs and videographs of the said offence of gang rape and threatened the victim with dire consequences if she revealed the incident to anyone. 7.
Thereafter, they brought the victim in the same van and pushed her out near a petrol bunk close to her residence before leaving the place. Semen was also found on the body of the victim. After thorough investigation, Charge Sheet has been filed. The accusations are well‑founded against the Petitioner. 4

Having regard to the entire facts and circumstances of the case, the nature and gravity of the allegations levelled against the Petitioner, and the specific overt acts attributed against him, this Court is not inclined to enlarge the Petitioner/Accused No.1 on bail at this stage. Accordingly, the Criminal Petition is liable to be dismissed. 9. In the result, the Criminal Petition is dismissed.
