JUSTICE RAJESH SHANKAR For the Petitioner : Mr. Kripa Shankar Nanda, Advocate For the State : Mr. Rakesh Ranjan, A.P.P. 02/30.04.2026 The petitioner is an accused for the offences punishable under Sections 25(1-B)a/26/29/35 of the Arms Act. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. There is alleged recovery of one country-made pistol along with two live cartridges of 9 mm each from the possession of the petitioner. In fact, there has been no such recovery from the possession of the petitioner. The false implication of the petitioner would be evident from the fact that the seizure list prepared in this regard does not bear signature of any independent witness. The petitioner was earlier involved in Bhandra P.S. Case No. 45 of 2020 for the offences under Sections 147/149, 380, 427, 323, 454, 509 of I.P.C., however the same ended in his acquittal on the basis of compromise as the dispute was between the neighbours. The petitioner is in judicial custody in connection with the present case since 11.03.2026. Hence, he may be given the privilege of regular bail. 3. Learned A.P.P. opposes the petitioner’s prayer for regular bail. 2026:JHHC:12687 - 2 - 4. Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on bail. 5. Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Gumla in connection with Gumla P.S.
