Order No.
ORDER 27.04.2026
01.
1. Since both the bail applications arise out of the same F.I.R. and involve the same issues, they are taken up together and are being disposed of by this common
order.
2. Heard.
3. The petitioners are seeking pre-arrest bail in connection with C.T. Case No.1423 of 2025 arising out of Laxmisagar P.S. Case No.758 of 2025 registered on
the allegation of the offences under Sections 118(2)/3(5) of B.N.S., 2023 read with Section 25(1)(a) of the Arms Act pending in the Court of the learned J.M.F.C.-V, Bhubaneswar and J.M.F.C.-IV, Bhubaneswar.
4.
Learned counsel for the petitioners, on instruction from the petitioners, submits that, except the present bail application, no other bail application of the petitioners are pending in any other Court relating to the aforesaid F.I.R.
5. On 27.12.2025 at about 10:30 p.m., the informant lodged a written report before the IIC, Laxmisagar Police Station, inter alia stating that while he, along with his friend, was proceeding to his village for dinner, the accused persons, owing to previous disputes and personal enmity within the locality (Sahi), attempted to kill him by means of a katuri, as a result of which he sustained injuries on his back. Hence, this case.
6. The petitioner in ABLAPL No.3386 of 2026 is 15 years old boy whereas the petitioner in ABLAPL No.3682 of 2026 is 18 years old.
7. Although an allegation of Section 118(2) of B.N.S., 2023 has been made and the injured has sustained grievous injury but regard being had to the age of the petitioners, I am inclined to grant the petitioners anticipatory bail. Accordingly, it is directed that in the event the petitioners are arrested, they shall be released by the Arresting Officer subject to the verification of the criminal antecedent of similar nature. The release of the petitioners shall also be subject to the conditions that they shall cooperate with the investigation and shall appear before the I.O. as and when their presence is required for the purpose of investigation. Violation of any of the conditions shall entail cancellation of bail.
8. With this observation, the ABLAPLs are
disposed of.
