Declyn Gerard Gomes, learned counsel for the petitioner. 2. This writ petition is filed seeking a direction to the Court of III Additional Principal Judge, Family Court, Bengaluru (hereinafter referred to as the ‘Family Court’) to dispose of MC No.6440/2022, which is pending on its file, in a time-bound manner. 3. Learned counsel for the petitioner submits that petitioner is the husband of the respondent. The petitioner filed MC No.6457/2022 for dissolution of marriage by decree of divorce. He submits that, the respondent has been intentionally delaying and protracting the proceedings. That the petitioner is working and residing in Hyderabad and has to look after his ailing parents. That very time the petitioner has to travel from Hyderabad to Bengaluru for the hearing by leaving his parents alone and even seek leave from his office. Hence, he seeks for a - 4 - HC-KAR NC: 2026:KHC:15938 WP No. 7905 of 2026 direction to the Family Court to dispose of the case in a time-bound manner. 4. The records would justify the submission made by learned counsel for the petitioner. Therefore, this Court deems it appropriate to dispose of the writ petition and give directions for speedy disposal of MC No.6440/2022. Hence, the following: ORDER (i) Writ petition is disposed of. (ii) The Court of III Additional Principal Judge, Family Court, Bengaluru is directed to take all steps for disposal of MC No.6440/2022 as expeditiously as possible on receipt of copy of this order. (iii) This Court is not issuing the notice to the respondent as no adverse orders are passed against and the petition is disposed of in the interest of both the parties. - 5 - HC-KAR NC: 2026:KHC:15938 WP No. 7905 of 2026 (iv) As the writ petition is disposed of without notice to respondent, Family Court is directed to serve copy of this order to respondent with a direction to the Family Court to serve a copy of this order so as to notify the respondent about filing of this petition and its disposal. (v) The parties shall co-operate for speedy disposal of MC No.6440/2022. (vi) Registry is directed to forward copy of this order to the concerned Court, forthwith.
