That, this Hon’ble Court may kindly be pleased to quash and set aside the impugned order dated 13.10.2025 (Annexure P/1) passed by the Divisional Level Rationalization Committee Raipur Division, Chhattisgarh. 10.2.That, this Hon’ble Court may kindly be pleased to quash and set aside the impugned order dated 24.06.2025 (Annexure P/2) passed by the District Level Rationalization Committee Gariyabandh, Chhattisgarh. 10.3. That, this Hon’ble Court may kindly be pleased to quash and set aside the impugned order dated 01.06.2025 (Annexure P/3) passed by the District Education Officer, Gariyabandh Chhattisgarh. 10.4.That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to rectify the subject classification of the Head Master Champoo Lal Ghoghre, by recognizing his actual subject as Hindi on the basis of his graduation mark sheet and service records. 10.5.That, this Hon’ble Court may kindly be pleased to direct the respondent authorities to allow the petitioner to continue at his original place of posting i.e. Government Primary School, Loharsi, Block Fingeshwar, District Gariyabandh, with all consequential service. 10.6.That, this Hon’ble Court may kindly be pleased to grant any other writ/writs, order/orders, or relief/reliefs in favour of the petitioner, which this Hon’ble Court may deem fit and proper in the facts and circumstances of the present case.” 3 2. Learned counsel for petitioner submits that petitioner, who is holding post of Teacher (LB) (Arts) and posted at Government Middle School Naveen Loharsi, Block Fingeshwar, District Gariyabandh, is transferred to Government Middle School Nisthiguda, Block Devbhog, District Gariyabandh under rationalization policy. He contended that petitioner has been erroneously transferred treating him to be a surplus teacher. He submits that Headmaster posted in Government Middle School Naveen Loharsi, Block Fingeshwar is teacher of Hindi language and not ‘Arts’ subject, therefore, petitioner, who is teacher (Arts), cannot be treated as surplus teacher. 3. Learned State Counsel opposing submission of learned counsel for petitioner, would submit that under the rationalization policy three tier committee has been constituted to consider grievance of teachers. Petitioner submitted representation before the District Level Committee and the Divisional Level Committee which was rejected vide order dated 13.10.2025 and 24.6.2025 respectively. Thereafter, petitioner has straightaway filed this writ petition in stead of submitting representation/appeal before the State Level Committee under the rationalization policy. 4. At this stage learned counsel for petitioner submits that petitioner may be permitted to submit representation/appeal before the State Level Committee under the rationalization 4 policy for redressal of his grievance as raised in this writ petition and in turn, said Committee be directed to take decision on the representation/appeal to be submitted by petitioner expeditiously within specified time. 5. Heard learned counsel for respective parties. 6. Taking into consideration facts of case and submission of learned counsel for respective parties, without expressing any opinion on the claim of petitioner, this writ petition is disposed of permitting petitioner to submit representation/appeal before the State Level Committee headed by the Director, Directorate of Public Instructions, Raipur (respondent No.2). If such a representation/appeal is submitted by petitioner, the same shall be considered and decided by the State Level Committee in accordance with law expeditiously, preferably within a period of three months from the date of receipt of representation/appeal to be submitted by petitioner. 7.
