THIS WRIT PETITION HAVING BEEN HEARD AND RESERVED FOR ORDERS ON 10.03.2026, COMING ON FOR PRONOUNCEMENT THIS DAY, THE COURT MADE THE FOLLOWING:- 3 CORAM: THE HON'BLE MR JUSTICE M.NAGAPRASANNA CAV ORDER Petitioners/accused Nos. 1 and 2 are before the Court calling in question registration of a crime in Crime No.217 of 2025 registered for offences punishable under Sections 3(5), 316(2) and 318(1) of the BNS. 2. Heard Sri D.R.Ravishankar, learned senior counsel appearing for the petitioners, Smt. Sowmya R., learned High Court Government Pleader appearing for respondent No.1 and Sri H.V. Praveen Gowda, learned counsel appearing for respondent No.2. 3. Facts, in brief, germane are as follows:- The family of the 2nd respondent/complainant and accused No.2/petitioner No.2 sat together and began talks of marriage of accused No.1 with the son of the complainant. In furtherance of the said talks, the family of the 2nd accused was requested to visit the house of the 2nd respondent. They did visit on 20-05-2025. On 4 01-06-2025 accused No.1 was asked to accompany them for looking at conventional halls for performing the engagement. It is alleged that the 1st petitioner was taken to the house of the complainant and showed the jewels that they are intending to give at the time of engagement and took photographs as to how the girl would look with the jewellery in the engagement, took back all the jewellery and went to saree shop for purchase of sarees. The girl/1st petitioner was not comfortable with the boy. The girl expressed that she needs some more time to understand the boy better on 04-06-2025. This appears to have gone wrong with the complainant and he became a bit violent and got disturbed. Based upon this, the 1st petitioner sought to give a complaint before the Girinagar Police Station on 05-06-2025. A notice that was sought to be served was not accepted by the complainant. Five days thereafter, a complaint comes to be registered by the complainant on 10-06- 2025 alleging criminal breach of trust and cheating which becomes a crime in Crime No.217 of 2025. It is this the girl and her mother are calling in question in this proceeding. 5 4. The learned senior counsel Sri D.R.Ravishankar appearing for the petitioners would vehemently contend that how criminal breach of trust and cheating can arise in the case at hand is ununderstandable. The families sat together and spoke about the marriage. The girl wanted some more time to think about the engagement or the marriage. The learned senior counsel would submit that the girl is entitled to think about her future with the man and, therefore, sought some more time. The boy was in a hurry, because of which the complainant became violent on the score that the engagement was sought to be postponed. The 1st petitioner/girl being aggrieved by the said act registered a crime on 05-06-2025. But, the present crime is registered by the complainant for offences punishable under Section 316 and 318 of the BNS which are Sections 406 and 420 of the earlier regime, the IPC. He would submit that the offences are neither made out nor there is any semblance of ingredients of the offence in the case at hand. 6 5. Per contra, the learned counsel Sri H.V.Praveen Gowda appearing for the 2nd respondent/complainant would refute the submissions by taking this Court through the complaint, which in detail narrates all that had happened and alleges that the 1st petitioner has taken away all the jewelries of the complainant which were given to her for wearing them for the purpose of photographs. He would admit that the photographs were taken in the house of the complainant itself. He would seek dismissal of the petition on the score where is the jewelry at least must be investigated into. 6. I have given my anxious consideration to the submissions made by the respective learned counsel and have perused the material on record. 7. The afore-narrated facts, dates, link in the chain of events are all a matter of record. A complaint is sought to be registered by the 1st petitioner on 05-06-2025, which reads as follows: “Police Inspector Girinagar Police Station Benglauru 7 Kruthika.G D/o. Respected Sir; We got matrimonial profile from Akshay and Family and we met them at hotel Krishna Grand an May 11th. My parents suggest to take sometime and talk for 2 months. But they were facing us to get the married early. During my multiple conversation with Akshay I came to know he is a bit Abnormal (A un-matured and Childish). I finally decided that I needed more time to understand Akshay better. But on 4th June Srinivas Murthy and his second son Ashray come to my house and spoke un-parliamentary language against me and my family. He is harassing us from yesterday that I took ½ kg Gold on 2nd June. When I visited their house on 2nd June they put the Gold on me to bee how it looks and they took it back saying they will gift me during marriage. Even since then, they are accusing me of taking ½ KG Gold from their house. I have not taken anything from their house except saree and salwar suit which they forced me to home to show it to my mother. I am ready to return the saree and salwar and also I do not ant force from their side to marry his son or harassment from their family. I went the mental torch to be stopped. The girl avers that what she had taken was saree and salwar which were given to her and would return them immediately if they want. This complaint is closed by the Police Station on the statements being recorded. Five days thereafter comes the subject complaint, which becomes a crime in Crime No.217 of 2025. Sections 316 and 318 of the BNS read as follows: “316. Criminal breach of trust.—(1) Whoever, being in any manner entrusted with property, or with any dominion over property, dishonestly misappropriates or converts to his own use that property, or dishonestly uses or disposes of that property in violation of any direction of law prescribing the mode in which such trust is to be discharged, or of any legal contract, express or implied, which he has made touching the discharge of such trust, or wilfully suffers any other person so to do, commits criminal breach of trust. Explanation 1.—A person, being an employer of an establishment whether exempted under Section 17 of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 (19 of 1952) or not who deducts the employee's contribution from the wages payable to the employee for credit to a Provident Fund or Family Pension Fund established by any law for the time being in force, shall be deemed to have been entrusted with the amount of the contribution so deducted by him and if he makes default in the payment of such contribution to the said Fund in violation of the said law, shall be deemed to have dishonestly used the amount of the said contribution in violation of a direction of law as aforesaid. Explanation 2.—A person, being an employer, who deducts the employees' contribution from the wages payable to 16 the employee for credit to the Employees' State Insurance Fund held and administered by the Employees' State Insurance Corporation established under the Employees' State Insurance Act, 1948 (34 of 1948) shall be deemed to have been entrusted with the amount of the contribution so deducted by him and if he makes default in the payment of such contribution to the said Fund in violation of the said Act, shall be deemed to have dishonestly used the amount of the said contribution in violation of a direction of law as aforesaid. Illustrations (a) A, being executor to the will of a deceased person, dishonestly disobeys the law which directs him to divide the effects according to the will, and appropriates them to his own use. A has committed criminal breach of trust. (b) A is a warehouse-keeper Z going on a journey, entrusts his furniture to A, under a contract that it shall be returned on payment of a stipulated sum for warehouse room. A dishonestly sells the goods. A has committed criminal breach of trust. (c) A, residing in Kolkata, is agent for Z, residing at Delhi. There is an express or implied contract between A and Z, that all sums remitted by Z to A shall be invested by A, according to Z's direction. Z remits one lakh of rupees to A, with directions to A to invest the same in company's paper. A dishonestly disobeys the directions and employs the money in his own business. A has committed criminal breach of trust. (d) But if A, in illustration (c), not dishonestly but in good faith, believing that it will be more for Z's advantage to hold shares in the Bank of Bengal, disobeys Z's directions, and buys shares in the Bank of Bengal, for Z, instead of buying company's paper, here, though Z should suffer loss, and should be entitled to bring a civil action against A, on account of that loss, yet A, not having acted dishonestly, has not committed criminal breach of trust. (e) A, a revenue officer, is entrusted with public money and is either directed by law, or bound by a contract, express 17 or implied, with the Government, to pay into a certain treasury all the public money which he holds. A dishonestly appropriates the money. A has committed criminal breach of trust. (f) A, a carrier, is entrusted by Z with property to be carried by land or by water. A dishonestly misappropriates the property. A has committed criminal breach of trust. (2) Whoever commits criminal breach of trust shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both. (3) Whoever, being entrusted with property as a carrier, wharfinger or warehouse-keeper, commits criminal breach of trust in respect of such property, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine. (4) Whoever, being a clerk or servant or employed as a clerk or servant, and being in any manner entrusted in such capacity with property, or with any dominion over property, commits criminal breach of trust in respect of that property, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine. (5) Whoever, being in any manner entrusted with property, or with any dominion over property in his capacity of a public servant or in the way of his business as a banker, merchant, factor, broker, attorney or agent commits criminal breach of trust in respect of that property, shall be punished with imprisonment for life, or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine. … … … 318. Cheating.—(1) Whoever, by deceiving any person, fraudulently or dishonestly induces the person so deceived to deliver any property to any person, or to consent that any person shall retain any property, or intentionally induces the person so deceived to do or omit to do anything which he would not do or omit if he were 18 not so deceived, and which act or omission causes or is likely to cause damage or harm to that person in body, mind, reputation or property, is said to cheat. Explanation.—A dishonest concealment of facts is a deception within the meaning of this section. Illustrations (a) A, by falsely pretending to be in the Civil Service, intentionally deceives Z, and thus dishonestly induces Z to let him have on credit goods for which he does not mean to pay. A cheats. (b) A, by putting a counterfeit mark on an article, intentionally deceives Z into a belief that this article was made by a certain celebrated manufacturer, and thus dishonestly induces Z to buy and pay for the article. A cheats. (c) A, by exhibiting to Z a false sample of an article intentionally deceives Z into believing that the article corresponds with the sample, and thereby dishonestly induces Z to buy and pay for the article. A cheats. (d) A, by tendering in payment for an article a bill on a house with which A keeps no money, and by which A expects that the bill will be dishonoured, intentionally deceives Z, and thereby dishonestly induces Z to deliver the article, intending not to pay for it. A cheats. (e) A, by pledging as diamonds articles which he knows are not diamonds, intentionally deceives Z, and thereby dishonestly induces Z to lend money. A cheats. (f) A intentionally deceives Z into a belief that A means to repay any money that Z may lend to him and thereby dishonestly induces Z to lend him money, A not intending to repay it. A cheats. (g) A intentionally deceives Z into a belief that A means to deliver to Z a certain quantity of indigo plant which he does not intend to deliver, and thereby dishonestly 19 induces Z to advance money upon the faith of such delivery. A cheats; but if A, at the time of obtaining the money, intends to deliver the indigo plant, and afterwards breaks his contract and does not deliver it, he does not cheat, but is liable only to a civil action for breach of contract. (h) A intentionally deceives Z into a belief that A has performed A's part of a contract made with Z, which he has not performed, and thereby dishonestly induces Z to pay money. A cheats. (i) A sells and conveys an estate to B. A, knowing that in consequence of such sale he has no right to the property, sells or mortgages the same to Z, without disclosing the fact of the previous sale and conveyance to B, and receives the purchase or mortgage money from Z. A cheats. (2) Whoever cheats shall be punished with imprisonment of either description for a term which may extend to three years, or with fine, or with both. (3) Whoever cheats with the knowledge that he is likely thereby to cause wrongful loss to a person whose interest in the transaction to which the cheating relates, he was bound, either by law, or by a legal contract, to protect, shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both. (4) Whoever cheats and thereby dishonestly induces the person deceived to deliver any property to any person, or to make, alter or destroy the whole or any part of a valuable security, or anything which is signed or sealed, and which is capable of being converted into a valuable security, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.” (Emphasis supplied) 20 Section 316 is 406 of the earlier regime, the IPC. It deals with criminal breach of trust. For an offence to become punishable under Section 316 of BNS entrustment of property is imperative. What property is entrusted in the case at hand is not divulged. Mere statement without any document of entrustment of property or merely alleging taking away jewellery of ½ kg cannot mean that the crime should be permitted to be continued. 8. The other offence is punishable under Section 318 of the BNS which deals with cheating. For an offence of cheating there should be allegation that a person fraudulently and dishonestly induced the victim to deliver any property from the inception. Therefore, the crime would emerge only if there is intention from the inception of dishonesty. Even that cannot be laid in the case at hand. The allegation is that talks of marriage broke down, did not reach even the stage of engagement and, therefore, it appears that the crime is registered to teach a lesson to the 1stpetitioner. If investigation, in such cases is permitted, it would be putting a premium on frivolousness in crime. It is in such circumstances the judgment of the Apex Court in STATE OF HARYANA v. BHAJAN 21 LAL1, becomes necessary to be noticed. The Apex Court holds as follows: “…. …. ….. 102. In the backdrop of the interpretation of the various relevant provisions of the Code under Chapter XIV and of the principles of law enunciated by this Court in a series of decisions relating to the exercise of the extraordinary power under Article 226 or the inherent powers under Section 482 of the Code which we have extracted and reproduced above, we give the following categories of cases by way of illustration wherein such power could be exercised either to prevent abuse of the process of any court or otherwise to secure the ends of justice, though it may not be possible to lay down any precise, clearly defined and sufficiently channelised and inflexible guidelines or rigid formulae and to give an exhaustive list of myriad kinds of cases wherein such power should be exercised. (1) Where the allegations made in the first information report or the complaint, even if they are taken at their face value and accepted in their entirety do not prima facie constitute any offence or make out a case against the accused. (2) Where the allegations in the first information report and other materials, if any, accompanying the FIR do not disclose a cognizable offence, justifying an investigation by police officers under Section 156(1) of the Code except under an order of a Magistrate within the purview of Section 155(2) of the Code. (3) Where the uncontroverted allegations made in the FIR or complaint and the evidence collected in support of the same do not disclose the commission of any offence and make out a case against the accused. 1 1992 Supp (1) SCC 335 22 (4) Where, the allegations in the FIR do not constitute a cognizable offence but constitute only a non-cognizable offence, no investigation is permitted by a police officer without an order of a Magistrate as contemplated under Section 155(2) of the Code. (5) Where the allegations made in the FIR or complaint are so absurd and inherently improbable on the basis of which no prudent person can ever reach a just conclusion that there is sufficient ground for proceeding against the accused. (6) Where there is an express legal bar engrafted in any of the provisions of the Code or the concerned Act (under which a criminal proceeding is instituted) to the institution and continuance of the proceedings and/or where there is a specific provision in the Code or the concerned Act, providing efficacious redress for the grievance of the aggrieved party. (7) Where a criminal proceeding is manifestly attended with mala fide and/or where the proceeding is maliciously instituted with an ulterior motive for wreaking vengeance on the accused and with a view to spite him due to private and personal grudge.” (Emphasis supplied) In the light of the afore-quoted judgment of the Apex Court, the complaint does not even make out a single ingredient of the offence. A relationship of discord, which did not even reach the stage of marriage, is now projected to become a crime. The girl was entitled to seek time of few more days to understand the boy with whom she would become a partner. Therefore, 23 misunderstanding and misgiving in a relationship that is yet to commence has become the fulcrum of misuse of criminal justice system. Therefore, to prevent abuse of the process of law and resultant miscarriage of justice, I deem it appropriate to exercise my jurisdiction under Section 482 of the Cr.P.C/528 of the BNSS and obliterate the crime. 9. For the aforesaid reasons, the following: ORDER (i) Writ Petition is allowed. (ii) FIR in Crime No.217 of 2025 registered before the Jayanagar Police Station on 10-06-2025 and pending on the file of 4th Additional Chief Metropolitan Magistrate, Bengaluru stands quashed.
