On the other hand, learned advocate for the State submits that the petitioner was intercepted when he was trying to cross the BOP at Ghojadanga. Additionally, it is submitted that from the possession of the petitioner Xerox coy of national Identity Card issued by the Government of Peoples Republic of Bangladesh was obtained. Having considered that some documents are in possession of the prosecution, at this stage, it is very difficult to assess regarding the contention of the petitioner relating to his Indian Citizenship, as such, I am not inclined to enlarge the petitioner on bail. 2 Hence, the prayer for bail of the petitioner is Rejected. The learned trial court would immediately frame charge and ensure that at least one witness is examined in a month. Accordingly, CRM(M) 643 of 2026 is dismissed.
