This application under Section 483 of the BNSS, 2023 has been filed Page No.# 2/3 by the petitioner, namely, Sri Prabhu Mahato, seeking regular bail in connection with Pragjyotishpur Police Station Case No. 165/2025 under Section 109(1)/117(2)/118(2)/3(5) of BNS. 3. On 22/12/25, complainant Biswajit Sarma, S/O Anil Sarma Of Kalvani Sagar Path, Kahilipara Dispur, Assam lodged an FIR at this P.S stating that on 21/12/25 when the complainant’s family was at Hatishila picnic spot for a get- together around 3 pm, a group of gang led by Prabhu Mahato Ananda Mahato, their family members and others, attacked the complainant's cousin Rakesh Sharma (Bablu) and Priyanshu Bora with sharp weapons without reason, attempting to loot and kill the two students. The complainant's driver, Rupankar Barman, took the injured persons to GMCH Emergency Ward. Medical reports indicate that both legs of Rakesh Rakesh Sharma (Baplu) were broken. 4. CD as called for has been received. 5. On perusal of the same, there appears to be sufficient incriminating material against the petitioner. However, having regard to the progress of the investigation made, and the period of detention of about 38 days in custody, further detention of the petitioner is not considered necessary. Accordingly, the prayer for bail is allowed. Page No.# 3/3 6. Petitioner shall be released on bail of Rs. 50,000/- with two sureties of the like amount to the satisfaction of the learned Elaka Magistrate, in connection of the aforesaid case. It is further provided that the petitioner shall cooperate with the investigation and shall not try to influence or intimidate the witnesses. 7. The petition stands allowed accordingly.
