He was transferred from Tehsil Roorkee to Tehsil Laksar vide order dated 03.08.2024. Petitioner challenged said transfer order on the ground that no option was called from him and since he is a senior employee, who is due to retire in the month of June, 2026, his transfer is in violation of Transfer Act, 2017. 3. Coordinate Bench of this Court passed an interim order on 22.08.2024, pursuant to which petitioner is still serving at Roorkee. 4. Transfer is an incidence of service; however, as per Government Policy, government servants are normally not to be transferred at the fag end of their service. 5. Having regard to the facts and circumstances of the case and also in view of 2026:UHC:712 the fact that petitioner is going to retire within four months, the writ petition is disposed of with liberty to petitioner to make representation against his transfer. If he makes representation within two weeks from today, decision thereupon shall be taken, as per law, within eight weeks thereafter. 6. For a period of ten weeks or till decision is taken, whichever is earlier, status quo, qua petitioner’s posting shall be maintained.
