01. Applicants have invoked Section 482 BNSS for their enlargement on bail in anticipation of arrest in case FIR No.25/2026 registered with Police Station, Samba, for the alleged commission of offences under Sections 332(c), 115(2), 304(1), 352, 351(2), 3(5) BNS, primarily, on the ground of false implication. 02. Background facts of the prosecution case are that on 25.01.2026, one Dheeraj Singh filed a written report alleging, inter alia, that on 23.01.2026 at around 6.45 p.m., while his brother was working in his shop, the petitioners/accused persons entered into his shop and threatened him. They demanded some money and when his brother refused, they started beating him. It was alleged that accused Deepak Rakwal attacked his brother with a sharp edged weapon (Hoora) on his forehead with an intention to kill him. His brother was dragged out of his shop and petitioners took away Rs.15,000/- from his pocket. On the Sr. No. 243

receipt of this report, aforesaid FIR came to be registered against the petitioners. 03. The plea has been opposed on the other side by the respondent-UT on the ground of gravity of the charge. 04. A perusal of the latest status report reveals that investigating agency has already obtained medical certificate of the injured from AIIMS, Vijaypur. PSI-Showkeet Iqbal, the investigating officer, present in the Court has submitted that injured has since been discharged from the hospital. The offences with which applicants have been charged are punishable with maximum imprisonment upto 07 years. 05. In the circumstances, since investigation of the case appears to be at the concluding stage, custodial investigation of applicants shall not serve any purpose of the investigating agency. 06. Hence, present application is allowed and applicants, in the event of their arrest, are directed to be released on bail on their furnishing a surety bond each in the amount of Rs.25,000/- and a bond of personal recognizance of the like amount, to the satisfaction of learned Registrar Judicial of this Court subject, however, to the following conditions that; i. they shall not leave territorial jurisdiction of this Court without prior permission; ii. they shall appear before the Investigating Officer, as and when called and co-operate in the investigation; iii. they shall attend in accordance with the conditions of the bail bonds;

iv.
they shall not commit an offence similar to the offence of which they are accused, or suspected; and v. they shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence. 07.
