The petitioner is an accused in the case registered for the offences punishable under Sections 111(2)(b), 310(4), 310(5), 310(6) of the Bharatiya Nyaya Sanhita (BNS), 2023 and Section 25(1-B)(a), 25(6), 26 & 35 of the Arms Act. 2. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and has not committed any offence as alleged in the F.I.R. There is alleged recovery of one country made pistol along with one live cartridge of 8 mm from the possession of the petitioner. In fact, there has been no such recovery from the possession of the petitioner and seizure list has been manufactured by the police. Moreover, the allegation that the petitioner along with others was planning to commit dacoity or extorsion is also false and concocted. Though one more criminal case is pending against the petitioner, however, he has already been granted regular bail in the said case. The petitioner is in judicial custody since 2026:JHHC:12698 2 17.12.2025. Hence, he may be given the privilege of regular bail. 3. Learned A.P.P. opposes the petitioner’s prayer for regular bail. 4. Having heard learned counsel for the parties and considering the materials available on record, I am inclined to enlarge the petitioner on bail. The petitioner is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Hazaribagh in connection with Charhi P.S.
