IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No.3201 of 2026 Krushna Chandra Nayak & Anr. …. Petitioners Mr. S.K. Rout, Advocate -Versus- State of Odisha …. Opposite Party Mr. M.K. Mohanty, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 27.04.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Panikoili P.S. Case No.05 of 2018 corresponding to C.T. Case No.53 of 2018 pending in the court of learned J.M.F.C., Jajpur Road on the grounds stated. 3. Perused the FIR as at Annexure-1. A copy of the chargesheet is produced by learned counsel for the petitioners at the time of hearing and the same is gone through. In the said chargesheet, it has been wrongly mentioned that the petitioners are on bail pursuant to the order in ABLAPL No.1224 of 2018. A copy of the said order is at Flag-B and it reveals that the petitioners were granted the liberty to surrender before the learned court below. Recorded the objection of the State with reference to the order in ABLAPL dated 7th December, 2018 at Flag-B. Since the petitioners had earlier approached this Court and were denied the bail with the disposal of the ABLAPL, the Court is not inclined to reconsider any such plea for pre-arrest bail at present but allows liberty for them to surrender before the learned J.M.F.C., Jajpur Road in connection with C.T. Case No.53 of 2018 seeking a regular bail and in case of rejection to approach the Sessions Court. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is further directed that in the event, the petitioners surrender within a fortnight from today and move applications for bail in connection with C.T. Case No.53 of 2018 arising out of Panikoili P.S. Case No.05 of 2018 pending in the Court of learned J.M.F.C., Jajpur Road, it is directed that the same shall be entertained during the first hour followed by an order and in the event of rejection, they are granted the liberty to approach the Sessions Court for orders during the second hour and for the said purpose, the lower court case record and other relevant papers shall be made available at the time of hearing. It is further directed that plea of parity of the petitioner shall be considered by the learned courts below while disposing of their bail plea. 6. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik) Judge Balaram Designation: PERSONAL ASSISTANT
