1. Heard Ms.Neeta Tulsani, learned counsel for the petitioner as well as Ms.Vaishali Mahilang, learned Deputy Government Advocate appearing for respondents No.1 to 3/State.
2. The present petition has been filed by the petitioner under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 with the following prayers :-
“It is therefore prayed that this Hon'ble Court may kindly be pleased to allow this petition and pleased to quash registration of First Information report No.284/25 vide First Information report dated 24.06.2025 for the offence u/s 420/34 of 109(1) of BNS, 2023, registered by the Police Station- Mohan Nagar, Distt. Durg (CG) and all consequential criminal proceedings arising (case.no.45446/2025, State of Chhattisgarh Vs. Shekhar Tandi) against the petitioner, charge sheet No.495/2025 vide charge sheet dated 23/11/2025 for the offence u/s 109(1) of BNS, 2023, filed against the present petitioner, order of cognizance dated 29/12/25 by which the learned Shri Bhupesh Kmar Basant Principal Judicial Magistrate, Distt. Durg (CG) has taken the cognizance in charge sheet No 495/202; case no. 45446/2025 for the offence under section 109(1) of BNS, 2023 against the petitioner, and further criminal proceeding in the matter of State of Chhattisgarh Vs. Shekhar
3 Tandi, in the interest of justice.”

Learned counsel for the petitioner submitted that a compromise has already taken place between the petitioner and the complainant in the present case, and stated that the injuries sustained by the complainant were simple in nature.
4. However, a perusal of the injury report shows that the injuries were serious in nature, as the ulna bone was found to be fractured.
