4. This is plaintiff’s writ petition challenging the order passed by Trial Court, as affirmed by Appellate Court. Trial Court rejected petitioner’s Temporary Injunction Application, vide
order dated
17.12.2021. Petitioner preferred appeal under Order 43 Rule 1 (r) CPC against the said order. The appeal was dismissed by Sixth Additional District Judge, Dehradun, vide order dated 21.04.2022.

Learned counsel appearing for respondent nos. 1 & 2 submits that the Original Suit No. 631 of 2019, filed by petitioner has been dismissed as withdrawn, therefore, the relief as claimed in the writ petition do not survive. The letter received from Sixth

25.03.2023.
6. After dismissal of suit, the relief as claimed by the petitioner in this writ petition do not survive.
7. Accordingly, the writ petition is dismissed as infructuous.
