Heard the learned counsel for the respective sides.
This appeal is directed against the order dated 18.03.2026 passed by the learned Incharge Additional Sessions Judge-I, Deoghar in A.B.P. No. 200 of 2026 arising out of Jasidih (Rail) P.S. Case No. 46/2025, whereby and whereunder, the prayer for anticipatory bail of the appellant has been rejected.
It has been alleged that five children who had been taken to Tamil Nadu were recovered and Nand Kishor Yadav as well as Vinod Yadav were apprehended.
Submission has been advanced by the learned counsel for the appellant that the appellant is not named in the First Information Report and has been implicated only on account of the fact that the Scorpio vehicle belonged to the appellant. It has been submitted that the notice u/s 35(3) of the BNSS has been served upon the appellant after seven months of the incident. Learned counsel further submits that the co-accused and the apprehended accused persons have been granted bail by this Court in Criminal Appeal (DB) No. 1057 of 2025.
Learned APP has opposed the prayer for bail of the appellant and while going through the supplementary case diary has stated that the apprehended accused as well as the appellant were in contact with each other prior to the incident as well as after the incident as would appear from the CDR. It has further been submitted that the Scorpio vehicle through which the five children were being trafficked was registered in the name of the appellant.
On consideration of the fact that the involvement of the appellant seems to be apparent on account of the Scorpio vehicle being registered in the name of the appellant and which was being used by the apprehended accused persons in trafficking five children and the fact that as per the CDR, there was a continuous talk between the appellant and the apprehended accused persons which
furthermore strengthens the case of the prosecution with respect the appellant being involved in human trafficking, we are not inclined to interfere with the order dated 18.03.2026 passed by the learned Incharge Additional Sessions Judge-I, Deoghar in A.B.P. No. 200 of 2026 arising out of Jasidih (Rail) P.S. Case No. 46/2025.
This appeal is accordingly dismissed.
