Learned counsel for State raises an objection with regard to maintainability of this writ petition on the ground that this writ petition is filed by petitioners against the decision of Divisional Joint Commissioner which is a Divisional Level Committee. Under the Rationalization Policy, State Level Committee is also constituted for the teachers who are aggrieved with the decision of Divisional Level Committee. 2. At this stage, learned counsel for petitioners submits that he may be permitted to withdraw this writ petition with liberty to file an appeal/representation before the State Level Committee and submits 3 / 3 that direction be issued to take decision on the appeal/representation submitted by petitioners, within a specified time frame. 3. Learned counsel for petitioners also submits that State Level Committee has considered similar nature of grievance raised by other similarly placed teachers and allowed their claim. 4. On due consideration of submission made by learned counsel for the respective parties, this writ petition at this stage is disposed of permitting the petitioners to file an appeal/representation before State Level Committee headed by DPI and if, such representation submitted the Committee/Authority shall consider and take decision on representation/appeal to be submitted by petitioners, in accordance with law, expeditiously, preferably within a further period of three week’s from the date of receipt of representation/appeal. 5.
