PUBLIC PROSECUTOR The Court made the following: ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.1 on bail in Crime No.05 of 2025 of Mampa Police Station, Alluri Sitharama Raju District, registered for the alleged offences punishable under Sections 111(2)(b) of the Bharatiya Nyaya Sanhita, 2 2023 (for brevity, ‘the BNS’) and Sections 20(b)(ii)(C) read with 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’). 2. Mr.Dasari Ramakoteswar Rao, learned Counsel for the Petitioner submits that the Petitioner is innocent of the alleged offence. He has been falsely implicated in this case. He has not committed any offence. He is a law- abiding citizen. He has got fixed abode. The Petitioners undertake to abide by any conditions that this Court may impose while granting bail. Hence, it is urged to allow the Criminal Petition. 3. Per contra, Mr.Neelotpal Ganji, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the Petitioner, and submitted that, though the Charge Sheet has already been filed in the case, the accusation against the Petitioner is well‑founded. Hence, it is urged to dismiss the Criminal Petition. 4. Heard the learned counsel for the Petitioners and the learned Assistant Public Prosecutor. Perused the record. 5. On perusal of the record, the Petitioner is arraigned as Accused No.1 in this case. The learned counsel for the Petitioner relied on the order of this Court in Crl.P.No.6141 of 2023 dated 30.07.2026 and urged that a similar order be passed. In the above-mentioned order, no adverse antecedents were reported against the Petitioner therein. However, in the present case, two similar adverse antecedents have been reported against the Petitioner. The Petitioner is alleged to have been involved in dealing with 1212.54 kgs of 3 ganja. This is not only a commercial quantity but also a colossal quantity. The allegation against the Petitioner is that he is a drug peddler. Earlier, two similar offences in which the Petitioner was involved also pertained to commercial quantities. The Petitioner surrendered on 07.07.2026. He has been in judicial custody for the past 38 days. The Charge Sheet was filed on 03.09.2025, within 180 days. The role of the Petitioner came to light based on the confession of Accused Nos.2 and 3. 6. Having regard to the entire facts and circumstances of the case, the nature and gravity of the allegations levelled, and the accusations against the Petitioner/Accused No.1 is well‑founded, this Court is not inclined to enlarge the Petitioner on bail at this stage. Accordingly, the Criminal Petition is liable to be dismissed. 7. In the result, the Criminal Petition is dismissed.
