1. Heard the parties.
2. The present criminal appeal is directed against the order dated 05.07.2025 passed by the learned Additional Sessions Judge-I Pakur, in connection with SC & ST Case No.06 of 2024, arising out of SC/ST P.S. Case No.01 of 2024 whereby, learned court below has been pleased to take cognizance of the offences against the respondent Nos.2 & 3 under Sections 341, 323, 325, 504 read with Section 34 of the IPC. The appellant is aggrieved with the aforesaid order to the extent that apart from the said offences, offences under Sections 3(1)(r), 3(1) (s) of the SC/ST Act as well as under Sections 307 & 379 of the IPC are also made out.

2. Criminal Appeal (S.J) No.932 of 2025
3. In view of the provisions of Section 362 of the BNSS, 2023, learned counsel for the appellant seeks permission to withdraw the present criminal appeal with a liberty to invoke the said provision in the pending trial.

Learned counsel for the other sides have raised no objection.
5. Permission is granted. Accordingly, the present criminal appeal is hereby, disposed of as withdrawn with the aforesaid liberty.
