03/28.04.2026 Heard the learned counsel appearing on behalf of the parties.

Learned counsel for the petitioner submits that the petitioner is in custody since 21.09.2024, in connection with Jadugora P.S. Case No. 0062 of 2024, corresponding to Sessions Trial No. 12 of 2025, for the offences registered under Sections 329(4), 74,76, 115(2) and 64 of the B.N.S. 2023, pending in the court of learned Additional Sessions Judge-I, at Ghatshila.

Learned counsel for the petitioner submits that though there is direct allegation that the petitioner entered in the house of the victim and committed rape upon her but the mother of the victim has been examined as witness before the court and she has stated that there was love affair between the victim and the petitioner and when the parents refused to marry, the case was lodged. He submits that out of 6 witnesses 3 witnesses have been examined and the petitioner is in custody since 21.09.2024 and the next date fixed in this case is
30.04.2026.

Learned counsel for the opposite party-State has opposed the prayer and has submitted that the victim has not yet been examined and there is allegation that the petitioner had forcibly committed rape upon the victim by entering in her house.

After hearing the learned counsel for the parties and considering the fact that victim has not yet been examined and the trial is going on and there is direct allegation against the petitioner and when the victim raised alarm, the neighbour gathered and caught hold the petitioner , this court is not inclined to enlarge the petitioner above

named on bail. Accordingly, prayer for bail of the petitioner above named is rejected.
6. However, the State is directed to ensure that the remaining three witnesses including the victim be examined before the court at the earliest.
7. The learned counsel for the State is directed to communicate this order to the Director Prosecution and the Superintendent of Police of the concerned District to ensure compliance.
8. Let this order be communicated to the court concerned through FAX/e-mail.
