Learned advocate appearing for the petitioner submits that the petitioner was earlier granted bail on 18.04.2023 in CRM (NDPS) 772 of 2023. Thereafter, he was not present before the Court, consequent to which harsher process of law was issued and petitioner was rearrested on 26.01.2026 and since then he is in custody. Learned advocate appearing for the State opposes the prayer for bail. The subject-matter of the case relates to alleged recovery of 100 bottles of Phensedyl and the petitioner was arrested on the basis of statement of co-accused. Having considered the period of detention of the present petitioner, I am inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is allowed. 2 Accordingly, the petitioner viz., Abbas Sk shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act-cum-Additional Sessions Judge, 5th Court, Berhampore, Murshidabad. If on bail, the petitioner shall meet with the Officer-in- Charge/Inspector-in-Charge, Domkal Police Station once in a week for a period of one year after his release. The application for bail, being CRM (NDPS) 586 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
