02/28.04.2026 Heard the learned counsel appearing on behalf of the parties.

Learned counsel for the petitioners submits that the petitioner are in custody since 06.03.2026 in connection with Sonari P.S. Case No.102 of 2025 for the offences registered under Sections 379, 387, 420, 504, 506, 120-B IPC and section 67(A) of the I.T. Act and the case is pending in the court of learned Special Judge (Cyber Crime), Jamshedpur.

Learned counsel for the petitioners submits that petitioners belong to the same family and are residents of Lucknow, Uttar Pradesh.
2026:JHHC:12371 2 [B.A. No. 3546 of 2026] Husband of the petitioner no.1 has lodged the instant case at Jamshedpur, alleging therein, that three months prior to the marriage, petitioner no.1 (wife) had created an Instagram account in the name of the informant without his consent. He lodged online cyber complaint and she had also told him that marriage was performed without her consent. It is alleged in the FIR that the petitioner no.1 is a habitual drunker besides the other allegations and she also refused to establish physical relationship with the informant. A mediation was also held on 12.01.2024 and during the said meeting, in-laws and parents of petitioner no.1 refused to lodge a complaint against one Nitesh Kushwaha with whom it is alleged that petitioner no.1 was having physical relationship.

Learned counsel for the petitioners further submits that as per the impugned order itself, notices were issued to the petitioner(s) under Section 35(3) of the BNSS, 2023 at Lucknow on 30.08.2025, 01.09.2025, 17.01.2026 and 19.01.2026 and despite service of notice, they did not appear and consequently, the warrant of arrest was issued and they have been arrested to secure their presence and in the event of their non-cooperation with the investigation, they have been arrested on
06.03.2026.

Learned counsel for the petitioners submits that the petitioners are ready to co-operate with the investigation and also ready to comply with any conditions as may be imposed and they will appear before the investigating officer on any date as fixed by this Court or even by the investigating officer of the case.

Learned counsel for the opposite party-State has opposed the prayer and has submitted that petitioners have been rightly taken into custody on account of non-cooperation on their part.

After hearing the learned counsel for the parties and considering the nature of allegation lodged by the husband of petitioner no.1 against petitioner no.1 (wife) and her family members residing at Lucknow, Uttar Pradesh, there appears to be matrimonial discord. Further, I.O. of the case had issued notice 35(3) of the BNSS, 2023 and in the event of their non-appearance, they have been taken into custody.
Keeping in view the aforesaid facts and circumstances, the petitioners above named are directed to be enlarged on bail on their
2026:JHHC:12371 3 [B.A. No. 3546 of 2026] furnishing bail bond of Rs. 25,000/- (Rs. Twenty-five thousand) each with two sureties of the like amount each to the satisfaction of learned learned Special Judge (Cyber Crime), Jamshedpur, in connection with Sonari P.S. Case No.102 of 2025 on the following conditions: (i) One of the bailors would be the present pairvikar of the petitioners. (ii) The other bailor should be a local resident of Jamshedpur. (iii) Petitioners are
directed to appear before the Investigating Officer of the case at the concerned police station on 13.05.2026 at 11:00 am and thereafter they shall continue to appear before the I.O. on every date as may be fixed by the I.O. (iv) Petitioners shall also provide their e-mail to the I.O. of the case so that date and time of their appearance be intimated at least three days in advance. (v) The petitioners will deposit a self-attested copy of his Aadhar Card along with their mobile number before the learned court which they will not change during the pendency of the case without prior permission of the court. (vi) In case the petitioners do not appear on any date, it will be open to the Investigating officer of the case to take all steps permissible under the law including cancellation of bail bond.
8. The instant bail application is allowed with the aforesaid conditions.
9. Let this order along with a copy of the affidavit filed with the bail petition be communicated to the court concerned through FAX/e-mail.
