CRMPM No. 370 of 2026 Main appeal has been preferred by Narcotics Control Bureau against the acquittal of respondent in a case instituted by the appellant under Sections 8, 20 and 29 of Narcotics Drugs and Psychotropic Substances Act,
1985. The criminal trial was instituted on the basis of complaint filed by the Narcotics Control Bureau through a public servant, therefore, appeal is being preferred by a public servant against acquittal in a case instituted by the public servant and, thus, application for leave to appeal has been filed under Section 419(4) of the Bharatiya Nagarik Suraksha Sanhita, 2023. Limitation for filing application for leave to appeal under Section 419(4) of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been provided in Section 419(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023, which provides six months period for preferring an application for seeking leave of the High Court to prefer an appeal against acquittal in a complaint case instituted by the public servant.
In present case, impugned judgment was passed by trial Court on 08.09.2025, copy of the judgment was applied on the very same day, which was attested on
19.09.2025. Thereafter, appeal has been filed on
27.02.2026. Six months after exclusion of time spent for receiving certified copy of impugned judgment would have expired on 19.03.2026, whereas application for leave to appeal has been preferred on 27.02.2026. Therefore, in view of provision of Sections 419(4) and 419(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023, application, seeking leave to appeal is within limitation period. Heard. Leave to appeal is granted. Application stands disposed of.
Cr.A(A-DB) No. of 2026 Cr.A(A-DB)ST No. 1254 of 2026 Be registered. Bailable warrants in the sum of Rs. 50,000/- with one surety in like amount to the satisfaction of the Arresting Officer/Executing Officer be issued to the respondent, returnable on next date. List on 19.05.2026.
