Bisht, Advocate for the respondent no. 2. (2) By means of this writ petition, petitioner has sought the following reliefs: “1. Issue an appropriate writ, order, or direction, directing Respondent No. 2 (Executive Officer, Nagar Palika Parishad, Nainital) and Respondent No. 3 to immediately evict Respondent No. 4 and his associates from the caretaker’s quarters, store room, and the premises of the Tallital Rickshaw Stand Public Toilet. 2. Issue an appropriate writ, order, or direction in the nature of Mandamus directing Respondents to ensure that the public utility is not misused for unauthorized commercial activities, extortion, or the exploitation of minors by Respondent No. 4. 3. Issue an appropriate writ, order, or direction, directing Respondent No. 1 and Respondent No. 3 to take action on the basis of the Petitioner’s written complaint dated 04.06.2026 against Respondent No. 4 (Rinku Kumar) and initiate appropriate legal action against him in accordance with the law marked UKHC010105502026 2026:UHC:5121 and annexed as ANNEXURE NO 4 page no. 27-28.” (3) This Court is not inclined to grant the reliefs as prayed for. Learned Counsel for the petitioner then submits that petitioner may be permitted to make representation to the competent authority. (4) Writ petition is, accordingly, disposed of by permitting the petitioner to make representation. If petitioner makes representation within ten days from today, decision thereupon shall be taken by the competent authority, as per law, within eight weeks thereafter.
