ORAL ORDER
Learned High Court Government Pleader takes notice for both the respondents.
The petitioner is aggrieved by the impugned Endorsement at Annexure - A issued by the Tahsildar, Hunsur Taluk. Learned counsel for the petitioner submits that Annexure - C is the temporary Saguvali Chit issued in favour of the petitioner's father Late Mr. Boraiah under the Grow More Food Scheme. After the death of the petitioner's father, the petitioner gave a representation dated 07.04.2022 at Annexure - B to respondent No.2 - Tahsildar, Hunsur Taluk bringing to his notice the fact that a temporary grant was already made in favour of his father and therefore, the petitioner requested for issuance of a Saguvali Chit.
In the impugned Endorsement at Annexure - A, the Tahsildar has stated that the application filed by the petitioner in Form No.53 seeking regularisation of unauthorised occupation is rejected on the ground that the lands in question fall within the prohibited distance from the boundary of Hunsur

Municipality. Learned counsel submits that by ignorance, the petitioner gave such a representation to the Tahsildar. Learned counsel submits that the petitioner may be granted liberty to approach the competent authority to seek permanent grant having regard to the facts narrated herein above.
Accordingly, the petition stands disposed of reserving liberty to the petitioner to approach the competent authority to seek a permanent grant following the temporary grant already made in favour of the petitioner's father. If such an application is made, the competent authority shall consider the same in accordance with law and dispose of the application within a time frame of three [3] months.
