BEFORE HON'BLE MR. JUSTICE DEVASHIS BARUAH ORDER Date : 04-06-2026 Heard Mr. Imti Longjem, learned counsel appearing on behalf of the applicant. Also heard Mr. T. B. Jamir, learned counsel appearing on behalf of the opposite party no. 1, who is the writ petitioner in the accompanying writ petition and Mr. L. T. Sangtam, learned Additional AG, Nagaland appearing on behalf of the performa respondent nos. 2 and 3/opposite party. 2. This is an application filed by the applicant seeking a direction that the applicant be arrayed as a party respondent to the accompanying writ petition. 3. This Court had duly taken note of the cause of action for which the writ petition was filed, whereby the order dated 06.11.2023 had been assailed.
This Court also takes note of that the order impugned in the writ petition which is dated 06.11.2023, confers certain rights upon the applicant and
Page No.# 4/5 under such circumstances, it is the claim of the applicant that the applicant is a necessary party for the adjudication to be made in the writ petition. 4. Mr. T. B. Jamir, learned counsel appearing on behalf of the opposite party No. 1, who is the writ petitioner in the accompanying writ petition opposes to the said application on the ground that the applicant is neither a necessary party nor a proper party for the purpose of adjudication of the accompanying writ petition. He further submits that an affidavit has been filed in objection to the instant application. 5. This Court has duly perused the said affidavit. 6. Upon perusal of the order impugned in the writ petition dated 06.11.2023, passed by the Office of the Deputy Commissioner, Dimapur, it is seen that the rights of the applicant have also been taken note of, and it is the opinion of this Court that any adjudication made in the accompanying writ petition without hearing the applicant would not be in the interest of justice. It is the further opinion of this Court that the applicant herein is a necessary party to the accompanying writ petition. 7. Accordingly, this Court impleads the applicant to the accompanying writ petition as respondent no. 10. 8. The learned counsel appearing on behalf of the writ petitioner is directed to file a fresh memo of parties before the Registry of this Court within 7 (seven) days from today, and
Page No.# 5/5 the Registry on the basis thereof, shall make necessary changes in the cause title of the accompanying writ petition as well as update the same in the CIS. 9. The IA stands disposed of. Sd/- JUDGE Comparing Assistant
