For Respondent(s) : Mr. Vivek Chaudhary, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 21/05/2026 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.318/2025, registered at Police Station Aravali Vihar, District Alwar, for the offence(s) under Sections 115(2), 126(2), 189(2) and 74 of BNS. 2. Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated in this case. It is contended that the accused-petitioner is in custody since 12.09.2025 and the other co-accused namely, Manish and Arun @ Pawan have already been enlarged on bail by the Co-ordinate Benches vide order dated 30.03.2026 and 16.12.2025 respectively. It is further contended that the cross case was also [2026:RJ-JP:21587] (2 of 3) [CRLMB-7726/2026] lodged by the accused-party against the complainant-party, the petitioner also received injuries and the trial of the case may take considerable time, therefore, the bail application of the accused- petitioner may be allowed. 3. Learned Public Prosecutor has vehemently opposed the bail application and contended that the specific allegations of causing injury dangerous to life on the head of the injured are attributed towards the present petitioner, therefore considering the nature of injury inflicted upon the injured, the bail application of the accused-petitioner may be dismissed. 4. Heard and perused the material available on record. 5. It is not desirable to express anything on the merits of the case. Considering the fact that the other co-accused namely, Manish and Arun @ Pawan have already been enlarged on bail by the Co-ordinate Benches vide order dated 30.03.2026 and 16.12.2025 respectively, it is also not disputed that the cross FIR was also lodged by the petitioner-party against the complainant- party and the petitioner also received injuries, therefore, considering the aforesaid facts, this Court deems it just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the instant bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner- Deepak S/o Kaluram, in connection with FIR No.318/2025, registered at Police Station Aravali Vihar, District Alwar, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before [2026:RJ-JP:21587] (3 of 3) [CRLMB-7726/2026] the court concerned on all the dates of hearing and as and when called upon to do so.
