The learned counsel appearing on behalf of the petitioner submits that the peremptory order was there and the defects were not removed within the stipulated time and in view of that the same has been dismissed. He further submits that now the petitioner has been taken into custody and in view of that also the defects as pointed out by the office is not surviving. 3. Learned counsel appearing on behalf of the respondent State has got no objection if the said petition is restored to its original file. 4. Considering the submission of the learned counsel for the petitioner, sufficient grounds have been made out for restoration of the said petition.
